TERMS AND CONDITIONS OF LIVERY SERVICES
1. Definitions
1.1 “We / Us / Our” means Central Horse Retirement Ltd (Company No. 05126670)
1.2 “You / Owner” means the person entering into this agreement
1.3 “Horse” means the horse or pony under your ownership or control
1.4 “Services” means the livery services selected and described on our website
1.5 “Contract” means the agreement formed between you and us incorporating these Terms
2. Formation of Contract
2.1 A legally binding Contract is formed when:
a) we confirm acceptance of your booking in writing; or
b) your Horse arrives at our premises and Services commence
2.2 We reserve the right to refuse admission of any Horse for reasonable grounds, including but not limited to:
a) unsafe or dangerous behaviour
b) inadequate health status or condition
c) failure to provide required documentation
d) non-payment or inability to secure payment
3. Services
3.1 We will provide the Services with reasonable care and skill
3.2 Services are provided in accordance with our standard practices and welfare principles
3.3 We reserve the right to make reasonable changes to Services where necessary for welfare, safety or operational reasons
4. Fees and Payment
4.1 Fees are as set out on our website or otherwise agreed in writing
4.2 A deposit is required to secure a booking
4.3 All fees must be paid in accordance with agreed terms
4.4 We reserve the right to review and amend fees with reasonable notice
5. Owner Responsibilities
5.1 You must provide accurate and complete information regarding your Horse
5.2 You must ensure your Horse is properly vaccinated, passported and in suitable condition
5.3 You must disclose any behavioural or health issues
5.4 You remain responsible for all costs associated with your Horse unless otherwise agreed
6. Veterinary and Farriery Care
6.1 We may obtain veterinary treatment where we reasonably believe it is necessary
6.2 You agree to pay all veterinary and associated costs
6.3 We will use reasonable endeavours to contact you prior to treatment, but may act without consent in emergencies
6.4 Routine farriery and dentistry may be arranged as part of the Services
7. Risk and Liability
7.1 Horses are kept at the Owner’s risk
7.2 We shall not be liable for illness, injury or death except where caused by our negligence
7.3 We shall not be liable for loss or damage to equipment or property
7.4 You agree to indemnify us against claims arising from your Horse
8. Welfare and Management
8.1 We prioritise the welfare of all horses in our care
8.2 We reserve the right to manage, separate or adjust care as necessary
8.3 We may refuse to continue Services where welfare is compromised
9. Termination
9.1 Either party may terminate the Contract by giving not less than three (3) months’ written notice
9.2 We reserve the right to terminate the Contract immediately in cases of:
a) non-payment of fees
b) breach of these Terms
c) behaviour posing a risk to staff, horses or operations
d) welfare concerns requiring removal or alternative management
9.3 Upon termination, all outstanding fees become immediately payable
9.4 The Owner remains liable for all livery fees and associated costs during the notice period, whether or not the Horse is removed prior to the expiry of that period
10. Removal of Horse
10.1 You must remove your Horse promptly upon termination
10.2 If a Horse is not removed, we reserve the right to take appropriate action, including:
a) arranging alternative livery
b) exercising a lien for unpaid fees
11. Insurance
11.1 We maintain appropriate public and employer’s liability insurance
11.2 You are responsible for insuring your Horse, including veterinary cover
12. Data Protection
12.1 We will process your personal data in accordance with applicable data protection laws
12.2 Your information will be used only for the provision of Services and related administration
13. General
13.1 These Terms constitute the entire agreement between the parties
13.2 Any variation must be agreed in writing
13.3 If any provision is held invalid, the remainder shall remain in force
13.4 These Terms are governed by the laws of England and Wales
